Probate Solicitors Manchester

Simplifying the Complex Journey of Probate

Probate is the legal right to deal with someone’s property, money, and possessions when they die. This includes the process of proving that a will is valid and confirming who has the authority to administer the estate of the person who has died. mlplaw is one of the leading probate solicitors Manchester residents trust when handling the affairs after a family member has passed away.

Before the next of kin, or executor, named in the will can claim, transfer, sell, or distribute any of the deceased’s assets they might have to apply for a grant of probate.

A grant of probate is a legal document that is needed to get access to bank accounts, sell assets, and settle debts after someone has died and left a will. Where no will was left, a grant of letters of administration is used instead and both documents serve the same purpose. When probate is granted, the next of kin or executor can begin to deal with the deceased person’s assets.

Our team of probate solicitors is here to assist with the probate process and getting legal affairs in order. Request a consultation with our team to discuss how we can help you to navigate through the complex journey of Probate.

    Testimonials

“My late mother’s estate unexpectedly went into probate after her death and the solicitor handling it was very old, very ill and his company was going under (unbeknownst to us!) When MPL Law took it over, Doris was our point of contact for the probate process. She took control of the situation, established a friendly but professional working relationship with me and helped me manage the stress I was under from family pressure to resolve the situation with humour and practical steps that her predecessor had been unable to achieve. I was never so glad to have someone on my side like Ms. Raggatt. I felt listened to and frankly, Doris made things happen. I was hugely impressed and would recommend her to anyone.”

    Paul

“Mlp Law and their fantastic solicitors Doris Raggatt, Victoria Hands and Chloe Linsley have provided excellent integrated probate and conveyancing services to handle my late mother’s estate and the sale of her flat. They have dealt with everything efficiently and smoothly and have kept me updated at every step of the way. This is not the first time I have required these types of services, but I can safely say their service offering is by far the best I have experienced. I would highly recommend these solicitors and Mlp Law.”

    Dr Shaun Abeysinghe, Review Solicitors

“I would have no problem with recommending this solicitor or using them myself again. They provided an excellent service throughout. The solicitor handling my request was Doris Raggatt and I found her straight forward and easy to deal with.”

    Barbara

“Jane Hunter was both helpful and accommodating. Communication was swift and my questions were always answered. Many thanks.”

    Joanna

I recently worked with Doris at MLP Law on legal matters relating to my late brother’s estate. She handled the legal matters with great professionalism and empathy, making a tough time easier for my family and me. Doris ws always available to answer questions and responded to questions promptly. I highly recommend Doris and MLP Law for their outstanding service and support.

    Frank, Review Solicitors

MLP Law were asked to deal with my brother’s estate as he died intestate and with a few complex issues amongst his paperwork. Types of Wills: Tailored to Your Needs

The world of wills offers various options, each designed to suit different circumstances and objectives. Choosing the right type is paramount to achieving your specific goals:

    • Simple Will: This is the most straightforward option, covering basic asset distribution and the appointment of guardians. It’s ideal for those with uncomplicated estates.
    • Living Will: It’s important to note that a Living Will (also known as an Advance Decision) is distinct from a Last Will and Testament. A Living Will focuses on your medical care preferences should you become incapacitated, rather than asset distribution.
    • Testamentary Trust Will: This type of will establishes a trust that comes into effect upon your death. It’s often used for the long-term care of beneficiaries, offering greater control over how assets are managed over time.
    • Pour-Over Will: Designed to work in conjunction with a living trust, a Pour-Over Will ensures that any assets not already transferred into your trust during your lifetime are “poured over” into the trust after your death, streamlining asset consolidation.
    • Joint Will: This is a single document created for two people, typically spouses or civil partners, outlining mutual inheritance provisions. While seemingly convenient, they can sometimes lead to complications in the future.

Our lawyers at mlpaw can help you determine which type of will best fits your unique circumstances and future aspirations.

Why Making a Will is Essential

Without a valid will, you are deemed to have died “intestate.” In such cases, strict state laws (known as intestacy rules) dictate who inherits your assets, which may not align with your true wishes. This can lead to unforeseen complications, disputes among family members, and a prolonged, more stressful process for your loved ones during an already difficult time.

Regardless of age, wealth, or family situation, everyone should seriously consider having a will. It’s the only way to ensure your intentions are legally honoured and to provide clarity and peace of mind for those you leave behind.

Probate: The Legal Journey After Death

Probate is the essential judicial process of validating a will and administering a deceased person’s estate. Even in the absence of a will, probate still takes place, but in such instances, assets are distributed strictly according to state intestacy laws, rather than your personal wishes.

The Probate Process: A Step-by-Step Guide

The main steps involved in the probate process typically include:

    1. Filing a Petition: The executor (if there’s a will) or an appointed administrator (if there’s no will) files a petition with the probate court, accompanied by the will (if applicable) and the death certificate.
    2. Notification: Creditors, named beneficiaries, and legal heirs are formally notified of the probate proceedings. In some cases, public notice may also be required.
    3. Inventorying Assets: The executor meticulously identifies, values, and reports all assets belonging to the deceased’s estate. This includes property, bank accounts, investments, and personal belongings.
    4. Paying Debts and Taxes: All outstanding debts, bills, and any inheritance or income taxes are paid from the estate’s assets before distribution to beneficiaries.
    5. Distributing Assets: Once all debts and taxes are settled, the remaining assets are distributed to the beneficiaries exactly as directed by the will, or according to intestacy laws if no will exists.
    6. Closing the Estate: Finally, the executor submits comprehensive financial records to the court and formally requests that the estate be closed, marking the completion of the probate process.

The Vital Role of the Executor

The executor plays a pivotal role in managing the deceased’s estate. Their responsibilities are extensive, including gathering assets, settling all debts, filing necessary tax returns, and ultimately distributing inheritances. If a person dies without a will, the court will appoint an administrator to undertake these crucial tasks.

    Common Probate Issues and Litigation

While many probate processes are straightforward, they can sometimes involve significant legal challenges, especially if:

    • The will’s validity is disputed, perhaps due to claims of undue influence, lack of mental capacity, or fraud.
    • There are disagreements among beneficiaries or heirs over asset valuation or the proposed distribution of the estate.
    • The executor is accused of misconduct or inefficiency in their duties.
    • There are unresolved debts or complex tax issues that complicate the estate.

Such disputes can lead to probate litigation, a challenging and often emotionally draining process that can strain family relationships and significantly prolong the administration of the estate.

Practical Considerations for Peace of Mind

    • Seeking Legal Advice: Probate can be incredibly complex, particularly for larger or contested estates. Consulting a specialist probate solicitor is almost always advisable to ensure a smooth, efficient, and legally compliant process.
    • Proactive Planning: A clear, well-drafted will, coupled with open communication with your family about your wishes, can go a long way in minimising potential disputes and easing the probate process for your loved ones during a difficult time.

In summary, creating a will is your opportunity to ensure your assets are distributed precisely as you intend, providing clarity and simplifying matters for your loved ones. Probate is the court-supervised process of settling your estate, a process that can be straightforward or complicated depending on the existence and clarity of your will, the nature of your estate, and any disputes that may arise.
