The main types of alternative dispute resolution (ADR)

Negotiation

Where parties communicate directly or indirectly to reach a mutual agreement and resolve their differences. This process is flexible and can be tailored to the needs of both parties, aiming for a win-win outcome without third-party intervention.

Mediation

Where parties meet with a neutral ‘mediator’ to resolve the conflicy. The mediator facilitates communication and helps craft solutions, without offering legal advice or taking sides.

Arbitration

Where parties submit their dispute to an ‘arbitrator’, an impartial expert who make a final, legally binding decision. Arbitration is often stipulated in commercial contracts for efficient, private resolution.

Benefits and disadvantages of mediation/negotiation

Advantages:

  • Typically, parties reach a compromise that is beneficial to both sides as it gives clients the maximum control and flexibility over the settlement.
  • Negotiation is a private, cost-effective way to settle disputes as it minimises financial and legal risk.
  • Resolution is faster compared to litigation
  • Less financial loss to businesses
  • Preservation of clients' business relations, encouraging cooperation and communication.

Negotiation/mediation may
not be the suitable approach when:

  • There is a large power imbalance between parties.
  • When one or both of the parties does not wish to communicate with the other.
  • When a client requires a court order to protect themselves or to prevent the other party from doing something (and negotiation/mediation has not achieved this).
In this instance, litigation is an appropriate method to settle the dispute

Testimonials

  1. What is dispute resolution?

Dispute resolution is the process of resolving conflict between parties.

  2. What is Alternative Dispute Resolution (ADR)?

Alternative Dispute Resolution (ADR) is used to as an alternative way to resolve a dispute without the need to go through court proceedings. It includes various methods to settle out of court such as negotiation, mediation, and arbitration.

  3. What is litigation?

Litigation is where formal legal action is taken to settle a dispute between parties. A dispute resolution solicitor handles every step of the court proceedings, and a judge will produce a legally binding ruling on the outcome of the case.

    Advantages of Litigation:

    • Definitive rulings issued by the court.
    • If any party feels that there was an error in the legal procedure or judgement, they have the right to appeal the result to a higher court.
    • A more thorough discovery of evidence than ADR techniques,
    • Public record of the dispute can sometimes clear speculation.

    Litigation Disadvantages:

    • More costly and time-consuming.
    • Public court procedure whereas some clients prefer privacy.
    • Less personal control over outcome.

  4. When is best time to consult solicitors in a dispute resolution?

It is recommended to seek expert legal advice as soon as a dispute arises. Our dispute resolution solicitors can help direct you to the most effective way forward, saving our clients time and money in the long run. .
