The main types of alternative dispute resolution (ADR)

Negotiation

Mediation

Where parties meet with a neutral ‘mediator’ to resolve the conflicy. The mediator facilitates communication and helps craft solutions, without offering legal advice or taking sides.

Arbitration

Where parties submit their dispute to an ‘arbitrator’, an impartial expert who make a final, legally binding decision. Arbitration is often stipulated in commercial contracts for efficient, private resolution.

Benefits and disadvantages of mediation/negotiation

Negotiation/mediation may
not be the suitable approach when:

  • There is a large power imbalance between parties.
